1. Scope of application

1.1 These General Terms and Conditions (GTC) apply to all orders of goods via the Yunari online store at www.yunari.ch by customers with a delivery address in Switzerland or the Principality of Liechtenstein (hereinafter "Customers").

1.2 The provider and contractual partner is Nowentra GmbH, Bahnhofstrasse 1, 5502 Hunzenschwil, e-mail: info@nowentra.ch, UID: CHE-209.917.609 (hereinafter "Provider").

1.3 Deviating terms and conditions of the Customer shall not apply unless the Provider expressly agrees to them in writing.


2. Offer, conclusion of contract and contract language

2.1 The presentation of the products in the online store does not constitute a legally binding offer, but a non-binding invitation to order.

2.2 By clicking on the button "Order with obligation to pay" (or equivalent), the customer submits a binding offer to purchase the goods contained in the shopping cart.

2.3 The contract is concluded as soon as the provider confirms the order by e-mail (order confirmation) or dispatches the goods.

2.4 The contract language is German.


3. Customer account

3.1 The customer can create a customer account. The customer is obliged to treat access data confidentially and to protect it from access by third parties.

3.2 The Provider may block or delete customer accounts in the event of misuse, suspected fraud or repeated violations.

 

4. Prices, shipping costs and price information

4.1 All prices are quoted in CHF and include statutory VAT, where applicable.

4.2 Additional shipping costs are shown separately in the checkout.

4.3 Price errors are reserved. In the event of an obvious price error, the supplier shall inform the customer immediately and offer either to continue the order at the correct price or to cancel it.

 

5. methods of payment

5.1 The payment methods offered in the store are displayed in the checkout (e.g. credit card, TWINT, invoice, PayPal, prepayment).

5.2 Depending on the payment method, the amount will be debited at the time of ordering or shipping.

5.3 In the event of late payment, the Provider is entitled to withhold delivery and to charge appropriate reminder fees and default interest to the extent permitted by law.

 

6. Delivery, delivery periods, partial deliveries

6.1 Delivery shall be made to the delivery address in Switzerland/Liechtenstein specified by the customer.

6.2 Specified delivery times are approximate. The customer will be informed of any delays in delivery.

6.3 Partial deliveries are permitted, provided they are reasonable for the customer. Additional shipping costs are only incurred if this is indicated accordingly in the checkout.

6.4 If a delivery is not possible for reasons for which the customer is responsible (e.g. incorrect address), the customer shall bear the resulting additional costs.

 

7. Retention of title

The delivered goods remain the property of the supplier until full payment has been made.

 

8. inspection of the goods, defects and warranty

8.1 The customer must inspect the goods immediately upon receipt and report any recognizable defects in writing (e-mail with sufficient photos) within 7 days of receipt.

8.2 In the event of justified notifications of defects, the supplier shall, at its own discretion, provide a replacement delivery or rectify the defect. If this fails or is unreasonable, the customer may demand a price reduction or - in the case of significant defects - withdraw from the contract.

8.3 Natural wear and tear, improper use, normal product ageing and damage caused by incorrect storage or non-compliance with instructions for use are excluded from the warranty.

 

9. return / exchange

9.1 The supplier voluntarily grants the customer a right of return of 14 days from receipt of the goods.

9.2 Prerequisite: The goods are unused, undamaged, complete and - if available - in their original packaging.

9.3 Excluded for reasons of hygiene and product protection are in particular opened or unsealed cosmetic products as well as articles that are not suitable for return for reasons of health protection if the seal has been removed after delivery.

9.4 The return costs shall be borne by the customer, unless the return is due to an error on our part.

9.5 Refunds will be made via the original means of payment as soon as the return has been checked.

 

10. Liability

10.1 The supplier does not guarantee that the products are suitable for specific purposes.

10.2 Liability for indirect damage, consequential damage and loss of profit is excluded to the extent permitted by law.

10.3 Product information serves as general information and does not replace individual advice. In the event of intolerances/allergies, the customer is responsible for checking the ingredients.

10.4 The supplier is not liable for delays or non-fulfillment due to unforeseeable events such as natural disasters or supplier disruptions.

 

11. vouchers / discount codes

11.1 Vouchers and discount codes are - unless otherwise stated - not cumulative and can only be redeemed once per order.

11.2 In the event of misuse, the provider may refuse redemption.

 

12. data protection

12.1 The Provider processes personal data in accordance with its data protection declaration at [Link].

12.2 For certain functions (e.g. payment processing, shipping, marketing/tracking), data may be passed on to service providers in Switzerland and abroad as described in the privacy policy.

 

13. Amendments to the GTC

The provider may amend these GTC at any time. The version published in the store at the time of the order shall apply.

 

14. Applicable law and place of jurisdiction

14.1 Swiss law shall apply.

14.2 For customers acting as consumers, the mandatory statutory places of jurisdiction shall apply. Otherwise, the place of jurisdiction is Hunzenschwil, Canton Aargau.

 

15. severability clause

Should individual provisions of these GTC be or become invalid or unenforceable, the validity of the remaining provisions shall remain unaffected.
